HIA Building Contracts
HIA Building Contracts
Advice on and review of HIA building contracts across Australia, before you sign, from a construction lawyer who is also a registered architect
HIA contracts, published by the Housing Industry Association, are among the most widely used residential building contracts in Australia. They are familiar to many builders and cover new homes, renovations and cost-plus work.
Like any standard form, an HIA contract is a starting point. Whether its payment terms, variation and delay provisions, and risk allocation suit a particular project depends on the job, the parties, and the home building legislation in the state where the work is done.
Christopher Larcos advises owners, builders and developers on HIA building contracts and reviews them before signing. His dual qualification as a solicitor and registered architect means the advice addresses both the legal terms and how the build will actually run, whether the project is in Sydney, Melbourne, Brisbane, Perth, Adelaide, Hobart, Canberra or Darwin.
How Christopher helps with HIA contracts
HIA contract review before signing
Reading the HIA contract you have been given, identifying risk, gaps and onerous terms, and setting out plainly what to accept, question or negotiate before you commit.
Payment and progress claims
Checking the deposit, the progress payment stages or schedule, and how they sit against your cash flow and the security of payment legislation in your state.
Home Building Act compliance
Confirming the contract meets the mandatory requirements of the governing legislation, such as the Home Building Act 1989 (NSW) and its equivalents across Australia.
Variations, delays and disputes
Assessing the variation procedures, extension of time provisions and dispute pathways, so the terms that decide who pays are understood before they are tested on site.
Common questions
What is an HIA building contract?
An HIA building contract is a standard-form contract published by the Housing Industry Association. HIA contracts are among the most widely used residential building contracts in Australia, covering new homes, renovations and cost-plus work, and are usually administered by the builder and owner directly rather than by an architect.
Should I have my HIA contract reviewed before signing?
A review before signing is the most cost-effective step an owner or builder can take. Most building disputes trace back to terms that were visible in the contract, and a specialist review sets out what to accept, what to question and what to negotiate while you still have the leverage to do it. A review is a fraction of the cost of a single payment or delay dispute.
What is the difference between an HIA and an ABIC contract?
HIA contracts are published by the Housing Industry Association and are typically administered by the builder and owner. ABIC contracts are published jointly by the Australian Institute of Architects and Master Builders Australia and are built around an architect administering the contract and certifying payments. The core difference is who administers the contract and the perspective the form is written from.
Can an HIA contract be amended?
Yes. Like any standard form, an HIA contract can be tailored with special conditions, whether to adjust the payment structure, add protections, or align it with the residential building legislation in your state. The important thing is that the amendments are drafted so they work with the base form rather than against it.
Which HIA contract should I use?
It depends on the work (a new home, a renovation, or cost-plus), the value of the project, and the home building legislation in the relevant state. Advice at the point of selection helps avoid signing the wrong form for the job, which is far harder to unwind once the build is under way.
