These Special Conditions have been developed to address practical limitations in standard ABIC contracts and to provide clear, workable solutions for use in real projects.
They are available for licence and may be used with either digital or paper versions of the relevant ABIC contract.
ABIC SW 2018 H NSW — Monthly Payment Structures & Targeted Amendments
Each option starts from the Monthly Progress Payments base and layers on additional protections: add Force Majeure for events beyond either party’s control, add Supply Chain to cap exposure to international cost shocks, or add both.
Monthly Progress Payments
Base option — Monthly Progress Payments only

Monthly Progress Payments + Force Majeure

Includes monthly payment provisions together with Force Majeure clauses addressing delay events beyond the control of the parties.
- Locks in monthly billing instead of stage payments.
- Suspends affected obligations during natural disasters, pandemics, war, or government acts; lets either party walk away after sixty continuous days of delay.
Monthly Progress Payments + Supply Chain Cost Increases

Includes monthly payment provisions together with clauses addressing cost increases arising from supply chain disruption.
- Locks in monthly billing instead of stage payments.
- Caps exposure to global cost shocks: only international-supply-dependent overruns above ten percent qualify, claimed on an open-book basis within twenty business days.
- The architect assesses every claim within twenty business days and adjusts the contract price; unilateral price hikes are excluded.

ABIC CP-2014 C Commercial Cost Plus — NSW Residential Compliance Solution
The ABIC CP-2014 C commercial cost plus contract is not compliant with the Home Building Act 1989 (NSW) and cannot ordinarily be used for residential building work. These Special Conditions modify the contract to the minimum extent necessary to achieve compliance, enabling its use on residential projects in New South Wales. This provides a practical and balanced alternative to standard cost-plus contracts commonly used in the residential sector.
NSW Residential Compliance Special Conditions

Special Conditions to amend ABIC CP 2014 C commercial cost plus for compliance with the Home Building Act 1989 (NSW).
- Once amended, the contract will comply with the Home Building Act and can then be used on projects involving residential building work in NSW.
